Products, custom solutions, and open source projects

These Terms of Service govern websites, software products, custom work, and open source projects from BitJet Software ("BitJet", "we", "us", or "our"). By using our sites, apps, or services, you agree to these terms. If you do not agree, do not use them.

1. Acceptance

You must be able to enter a binding agreement. If you act for an organization, you confirm you have authority to bind it to these terms.

2. Our products

BitJet publishes ready-to-use software products and apps (including mobile and web). Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use each product as intended.

  • Do not copy, reverse engineer, or decompile our product software except where the law allows
  • Do not rent, sell, sublicense, or commercially redistribute our products without written permission
  • Do not remove branding, notices, or attribution, or interfere with security and normal operation
  • Product features, availability, and pricing may change; store listings and in-app notices may add product-specific terms
  • Products may use third-party services (e.g. ads or maps); those providers have their own terms and privacy policies

3. Custom solutions

Custom solutions are project-based work we deliver for a client—such as bespoke apps, integrations, or systems. Website descriptions are general only. Scope, deliverables, timelines, fees, ownership, and support for custom work are defined in a proposal, statement of work, or other written agreement with BitJet.

  • You are responsible for accurate requirements, timely feedback, and lawful use of materials you provide
  • We may pause or end engagement if payment, scope, or acceptable-use obligations are not met, as set out in the project agreement

Full source code projects

When a custom engagement is sold as a full source code project (and that is stated in the written agreement), upon full payment and delivery of the agreed source you receive broad freedom over that deliverable. Unless the agreement says otherwise, you may use, copy, modify, extend, rebrand, host, commercialize, and transfer that project and its source as you choose, including for your own products or for third parties.

  • Ownership and rights transfer only for the specific full-source deliverables covered by that agreement—not for BitJet products, tools, or reusable libraries we did not assign
  • Third-party open source or licensed components included in the project remain under their own licenses; your freedom applies to our work and any assets we assign to you
  • Pre-existing BitJet IP, internal tooling, and know-how stay with us unless expressly assigned in writing

4. Open source projects

BitJet may publish open source software, samples, or libraries. Use of those projects is governed by the license file included in each repository (for example MIT, Apache-2.0, or another stated license)—not by the product license in section 2.

  • Read and follow the project's LICENSE and any NOTICE or contribution guidelines
  • Open source is provided "as is" unless a separate support contract says otherwise
  • Contributions you submit may be accepted under the project's license and contribution terms
  • Trademarks and BitJet branding are not licensed for use beyond what the open source license allows

5. Acceptable use

You may not use our sites, products, custom deliverables, or open source projects to break the law, infringe others' rights, distribute malware or spam, attempt unauthorized access, or harass others.

6. Intellectual property

Except for rights we expressly grant (product license, custom agreement including full source code assignments, or open source license), BitJet and its licensors keep all rights in software, designs, trademarks, and documentation.

7. Disclaimers and liability

To the fullest extent permitted by law, our websites, products, and open source projects are provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation. Except where mandatory law requires otherwise, we are not liable for indirect, incidental, or consequential damages arising from use of free products, open source, or unpaid materials.

Money remedies apply only to custom solutions you have paid for under a written agreement with BitJet. They do not apply to our ready-made products, open source projects, or unpaid evaluations.

  • Interrupted development — undone work only: If the development process for a paid custom solution is interrupted (for example the engagement ends before completion), you may request a refund limited to amounts you paid for work that was not done. Fees for work already completed and delivered (or ready for delivery under the agreement) are not refundable, except as required by law or as we expressly agree in writing.
  • Mistakes and damage: If damage results from a clear mistake on our part in paid custom work, our remedy is to make it right by offering a discount on remaining or future fees for that engagement and/or extra related service at no charge as recompense. We do not provide open-ended cash damages beyond those remedies, except where mandatory law requires otherwise.

A project agreement may set additional or different refund and remedy rules for that engagement; if it conflicts with this section, the written project agreement controls for that custom solution.

8. Changes and contact
